2. Eligibility & Account Registration

• Age: You must be at least 18 years old to use Growpins. By registering, you confirm you meet this requirement.
• Accurate Information: You must provide accurate, current, and complete information during registration and keep it up to date.
• Account Security: You are responsible for keeping your login credentials confidential. Notify us immediately at info@growpins.ai if you suspect unauthorised access to your account.
• One Account Per User: You may not maintain more than one account or create an account on behalf of another person without their explicit consent.

3. Acceptable Use

You may use Growpins to create and manage your online store, list products, use AI tools, and grow your business. You agree to use the platform lawfully and in good faith.

You must not use Growpins to:

• List, sell, or promote illegal, counterfeit, or regulated goods without proper licensing
• Upload content that is defamatory, obscene, harassing, or infringes a third party's intellectual property rights
• Misrepresent your identity, products, pricing, or business credentials
• Use automated bots, scrapers, or tools to extract data from the platform without our written consent
• Attempt to gain unauthorised access to any part of our systems or another user's account
• Transmit spam, phishing links, or malicious code
• Use the platform in any way that violates applicable local, national, or international law

4. Intellectual Property

• Our IP: All software, design, text, graphics, logos, and features of the Growpins platform are owned by or licensed to Growpins AI. You may not copy, reproduce, or create derivative works from any part of the platform without our express written permission.
• Limited Licence: We grant you a personal, non-exclusive, non-transferable licence to access and use the platform solely for its intended purpose during your active subscription or free trial.

5. User Content & Product Listings

• Ownership: You retain ownership of all product images, descriptions, and other content you upload to your store.
• Licence to Us: By uploading content, you grant Growpins a non-exclusive, royalty-free, worldwide licence to host, display, and process your content solely to provide and improve our services.
• Responsibility: You are solely responsible for ensuring your content is accurate, lawful, and does not infringe any third-party rights. Growpins does not verify or endorse seller listings.
• Takedowns: We reserve the right to remove any content that we reasonably believe violates these Terms, applicable law, or third-party rights, without prior notice.

6. AI-Generated Content

Growpins uses AI to generate product titles, descriptions, SEO tags, and other content on your behalf. You acknowledge that:

• AI-generated content is provided as a starting point and may not always be accurate, complete, or suitable for your specific product or market
• You are responsible for reviewing and verifying all AI-generated content before it is published on your store
• Growpins does not guarantee specific SEO rankings, traffic levels, or sales results from the use of our AI tools

7. Subscriptions & Free Trial

• Free Trial: We offer a free trial for new accounts. No payment details are required to start. At the end of the trial, your account will move to the free tier or require a paid subscription to access premium features.
• Paid Plans: Subscription plans and pricing are detailed on our Pricing page. Fees are charged according to your selected plan and billing cycle.
• Zero Transaction Fees: Growpins does not charge a percentage of your sales. You keep 100% of what you earn from buyers.

8. Termination & Suspension

• By You: You may close your account at any time by contacting info@growpins.ai. Closing your account does not entitle you to a refund of any prepaid subscription fees.
• By Us: We may suspend or terminate your account immediately if you breach these Terms, engage in fraudulent activity, or if required by law. We will notify you unless doing so would compromise a security investigation or is prohibited by law.
• Effect of Termination: Upon termination, your access to the platform ceases. Your store data may be deleted after a 30-day grace period.

9. Disclaimers

The Growpins platform is provided "as is" and "as available." We do not warrant that the platform will be uninterrupted, error-free, or free of vulnerabilities. We do not guarantee any particular commercial outcomes from using our services. To the fullest extent permitted by law, we disclaim all implied warranties including merchantability and fitness for a particular purpose.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Growpins AI will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, profits, or data, arising from your use of or inability to use the platform. Our total liability to you for any claim arising under these Terms will not exceed the total fees you paid to us in the 12 months preceding the claim.

11. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms will be subject to the jurisdiction of the courts of England and Wales, without prejudice to any mandatory consumer protection rights you may have under the law of your country of residence.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or via a notice on the platform at least 14 days before the changes take effect. Continued use of the platform after that date constitutes acceptance of the revised Terms.
